Images have emerged of the couple as they spent time together on Monday, after years of them allegedly trying to keep their romance a secret.
It was previously claimed that Holmes, who divorced husband Tom Cruise in 2012, had a clause in her divorce settlement which banned her from publicly dating for five years. If true, it is understood that this clause has now expired.
In the images, the couple can be seen holding hands and talking and laughing together as they walk along the beach. They spent America's Labor Day holiday at an oceanfront home.
Holmes, 38, and 49-year-old Foxx were first romantically linked in August 2013, over a year after the actress divorced Cruise, with whom she shares 11-year-old daughter Suri.
Over the years, the Holmes and Foxx have been spotted together on a few occasions, leading to continued speculation that they were dating. While Holmes never commented on the claims, her reported beau denied the reports, saying it was "fake news" and that they were "just friends".
Neither party has commented on the most recent images.
