Thomas Beatie (39) has been married to wife Nancy for 10 years, Newstalk.ie has said.
Beatie was born as a woman but began living as a man in his 20s. Legally changing his name, he kept his female reproductive organs.
After marrying in 2003, the couple went on to have three children together through artificial insemination; however the Arizona resident filed for divorce last year.
He claimed he was seeking dissolution of his marriage and hoping to marry his new girlfriend.
However, a Family Court Judge ruled last Friday that Beatie had failed to prove in his divorce petition that he was a man when he married over a decade ago. As a result, he was therefore unable to show that he and his wife were a heterosexual couple.
Same-sex marriages are not recognised in the state of Arizona, leaving the Judge to rule that he could not grant the divorce.
The judge did however approve a property and custody settlement for the couple. The 39-year-old said he could seek review by the Arizona Court of Appeals or the US Supreme Court.
