The 42-year-old actress is said to have cited adultery as the reason for the couple's split.
Last month, it was revealed the pair had ended their seven-year marriage after Ellis was alleged to have cheated on his wife.
The actor was then reported to have confessed to a one-night stand while he was in the US earlier this year filming 'Gothica'. Outhwaite was said to be wanting to save their relationship, but has since decided to legally end their union.
A source is quoted by The Sun as saying: "Tamzin desperately tried to make it work.
"Tamzin has cited adultery, so she will have a huge advantage when it comes to negotiations. Tom's a reasonable bloke and as it's pretty cut and dried they could be divorced within months."
Ellis has moved out of the family home, but both he and Outhwaite have promised to stay on friendly terms for the sake of their children.
The couple married in 2006, just one year after they met through mutual friend, James McAvoy. They have two children together, four-year-old Florence and one-year-old Marnie Mae.
