Beth Warren, from Birmingham, lost her husband Warren Brewer to a brain tumour two years ago. Before he started his cancer treatment, the ski instructor had his sperm frozen and signed paperwork to say his wife could use the sperm if he died.
However, while sperm and eggs are currently allowed to be stored for up to 55 years - if consent is renewed every decade - due to Mr Brewer's death, consent could no longer be given. The laws therefore meant that the deceased's sperm was to be destroyed in April 2015. According to the BBC, Mrs Warren argued that the regulations did not make sense.
In a ruling on Thursday, the High Court supported her argument.
The couple were together for eight years and married just six weeks before Mr Brewer died. His widow subsequently changed her surname to Warren.
