It is thought the ruling will be made later this year, which could pave the way to fully legalise same-sex marriage in the US.
The court has previously struck down a law to stop federal recognition of marriages in those states which allowed gay marriage.
Following this ruling, a number of decisions in regional federal appeal courts saw the end of various gay marriage bans in certain states. To date, 36 states, as well as the District of Columbia, can issue a marriage licence to same-sex couples. Bans remain in place in 14 states.
When deciding on the ruling, the justices will consider whether the US constitution requires states to issue marriage licences to same-sex couples, and whether states should recognise those marriages if they are performed in other states.
The case will be argued in April, with a decision expected by late June.

The Supreme Court in America is to decide whether gay couples have a right to marry across all states, it has been reported.It is thought the ruling will be made later this year, which could pave the way to fully legalise same-sex marriage in the US.
