According to a number of reports, Patrisha has filed legal papers citing “adultery, cruel and abusive treatment, and irreconcilable differences” for the split.
The news comes just two months after the 'American Pie' singer was arrested for domestic violence. He has denied the charges. He has also been prohibited from contacting his wife.
A statement from Patrisha's lawyer, Gene Libby, reads: "After having time to reflect on her marriage, Patrisha decided that divorce is in her best interest, both physically and emotionally.
"Since Don McLean's arrest for domestic violence assault, domestic terrorising, domestic violence criminal threatening, criminal restraint and criminal mischief on January 18, 2016, Don has been prohibited from contacting her, and she has gained strength and insight away from his influence and control.
"The domestic violence event of January 18, 2016 is one of many abusive episodes resulting from his rage and controlling behavior throughout the marriage."
A lawyer for Don said his client denies the characterisations made by his wife's lawyer, and that he "cares very deeply about his wife and family."
Don and Patrisha, 56, have been married for 30 years. They have two children together; Jackie and Wyatt.
