It is understood the High Court of Australia dismissed two separate legal challenges that argued the proposed postal vote was invalid.
A non-binding survey to gauge support for changing Australia's Marriage Act is due to begin next week. While the survey does not have the power to make same-sex marriage legal, it could lead to a vote in parliament.
The voluntary survey is said to have cost around £75 million and there is concern that it will fuel hate-filled campaigns. Those who challenged the survey have said the vote was invalid because it was not approved through parliament. It was also claimed that the Australian Bureau of Statistics did not have the authority to oversee the process.
However, the court has now dismissed those arguments.
Australians will have from Tuesday until 27 October to cast their vote with the results expected to be announced on 15 November.
