The '24' actress filed documents to end her union with the personal trainer and actor, who she wed in Las Vegas in 2009.
According to TMZ, the split date is listed on court documents as 12 June, and Mary is believed to be seeking joint physical and legal custody of their son Valentine, aged 11.
Ten years ago, the pair wed in a spur of the moment Vegas casino ceremony. The actress said at the time: "Our wedding was beautiful, spontaneous and intimate. We are so excited to officially be husband and wife."
